Why do I need a certified copy of my deed?

When you purchase a piece of real estate the transfer of title from the current owner to the buyer is made via a legal document called a deed.  Deeds show ownership to real estate as well as a legal description (sometimes called a metes and bounds description) of the parcel.  The settlement company or attorney’s office files an original copy of the transfer in the local governing office.  Most counties today keep such records in the Recorder of Deed’s Office.  Both the buyer and the seller of the property each should receive copies of the transaction as well.  Over time many people misplace their copies or fail to see the need to keep an original copy on hand.  It is important to keep a copy of your deed in a safe place, such as a bank issued safe deposit box.  Every homeowner should have a copy of their deed in an easily accessible place in case the need ever arises to prove ownership or settle a boundary dispute.  Deed copies can also be helpful to prove residency, or help in the creation of a new transfer of ownership.

What is a “Certified” copy?

A certified, sometime referred to as an exemplified copy, is a Court issued copy of a deed previously recorded in the appropriate legal jurisdiction.  A certified copy, while not having original signatures, is the same legally as a true original copy.  Since the copy is certified by the local governing body it is recognized by the legal system as being the same as the originally signed instrument.

How long will it take to get my copy?
